Called to Order:  7:35 PM under the M.G.L. Chapter 131, s.40 and the Hanson By-Law 1-13, s.5.  by Philip R. Lindquist, Chairman, in the Conservation Office on the second floor of Town Hall.

8:00 PM  Notice of Intent for construction of a roadway, a residential dwelling including utilities, associated site work and paving at Pine Grove Ave. & Fallon Point Rd., Assessor’s Map 69, Lots 3H-2 & 3H-3 for Kevin Johnson, 86 Pine Grove Ave. represented by P.M.P. Assoc., LLC of 200 N. Bedford St., E. Bridgewater, MA  (DEP #175-)  (New Hearing)
Craig Nicholson read the Public Hearing Notice and the green cards were checked.  David Johnson of P.M.P. Associates presented revised plans with additional haybale/silt fence detail.  The proposal calls for the connection of two roads, Pine Grove Ave. & Fallon Point Rd. to provide frontage for the new dwelling.  The applicant has applied for a subdivision permit with the Planning Board.  Robert M. Gray, P.W.S, flagged the bordering vegetated wetland..   The applicant is requesting a variance for two areas of grading that are within the 50-foot no disturb zone.  One area is 850 sq.ft., the other 350 sq.ft..   The house, driveway and a sub-surface, storm water infiltration system are located within the 100-foot buffer zone.  Mr. Grattan asked if the house could be turned to get it away from the 50-foot buffer.   David Johnson replied that because the wetlands were already altered, they are asking for a variance and they also have to comply with zoning setback requirements.  Mr. Nicholson asked for comments from abutters:

Paul & Kathleen Hanson, 94 Pine Grove Ave. – Mr. Hanson asked where the clearing was.  Mr. Johnson replied that it is at the edge of the tree line.
Todd & Barbara Chamber, 74 Pine Grove Ave. -  Mrs. Chamber had concerns about water coming from Fallon Point Road.  Where does it end up?  She doesn’t want a pond in her backyard.  Mr. Johnson explained that the drainage easement should address her concerns.
Howard & Patricia Bezanson, 523 Maquan St. -  Mr. Bezanson also had concerns with a well.  However, he is OK with the plan.  His questions were addressed.  
Joan Dilillo, 95 Roller coaster Road -  Ms. Dilillo had concerns with drainage and impact on other residents in the area.

Ms. Cassady set up a site visit for Saturday, May 22nd at 10 AM.

8:15 PM  Appointment with Dennis and Darcy MacDonald of 97 Bonney Hill Lane.  Mr. & Mrs. MacDonald would like to put a swing set in their yard and put in a hedge along the buffer zone.  They would also like to clear some brush outside of the 50-foot buffer zone.  Ms. Gardner asked if the area would be loamed and seeded.  She suggested we write a letter of approval for the MacDonald’s.  The Board thanked the MacDonald’s for coming in.

8:30 PM  Continued Notice of Intent for construction of a 19,200 SF contractor’s building and yard with associated grading, driveway and detention basin as well as filling approx. 2,732 SF of wetlands with a replication of 4,198 SF as shown on the site plan at Industrial Blvd., Assessor’s Map 67, Lot 17-13, for West Hanover Strawberry Hill, LLC, 1401 Hanover St., Hanover, MA represented by Merrill Assoc., Inc., 427 Columbia Rd., Hanover, MA  (DEP#175- ) – cancelled and rescheduled for Tuesday, May 25th at 8:30 PM.

8:45 PM Continued Request for Determination of Applicability to determine if the removal of four (4) trees at 592 Main St., Assessor’s Map 41, Lot 2A-1 is subject to the jurisdiction of the Wetlands Protection Act for owner Christopher J. Collins.   

Ms. Cassady had made a site inspection.  There is a drainage ditch behind the trees.  An oak tree at the front of the driveway is an obstruction to traffic.   Her suggestion is to allow the removal of the trees, but to specify in the Determination to leave the stumps and to not disturb the shrubbery and saplings.  Ms. Cassady will go to the site and use flagging tape to identify the trees in question and take pictures.

9:00 PM  Continued Notice of Intent for a septic system repair at 1 Emory St., Assessor’s Map 2, Lot 50 for John Rothwell, owner, represented by Alan Dias, P.O. Box 314, Monponsett, MA  (DEP #175-422)

Mr. Dias presented a letter of approval from the DEP to the Hanson Board of Health in regards to their request for variance for use of the JET treatment system.  (See minutes of April 27, 2004)  The letter also referred to special conditions that must be adhered to.  Mr. Dias asked if Mr. Rothwell could put in a weed block of riprap in lieu of grass along the weed bank.  Ms. Cassady was vehemently opposed to the riprap as it would destroy habitat and suggested a row of rhododendrons instead.

(approx. 312 sq.ft) in the 100-foot buffer zone at Elm St., Assessor’s Map 36, Lots 8-1R & 8-2R for Donald Shute, 345 Washington St., Pembroke, owner. (DEP #175-428)

The Department of Environmental Protection issued an identifying number and approval after much waiting.  Please refer to minutes of March 9, 2004.

Orders of Conditions/Order of Resource Area Delineation

Orders of Conditions for construction of a single family house and septic system at Holly Ridge Drive, Assessor’s Map 111, Lot 115 for Keene Contractor’s P.O. Box 185, Hanson, MA represented by Webby Engineering, 180 County Rd., Plympton, MA with special conditions:  (DEP #175-419).   1.  Prior to the start of any construction, haybales and silt fence shall be installed as shown on approved plans and a site visit shall be scheduled with the Conservation Office.  Please call 781-294-4119, Ext. 118.  2.  The yard shall be loamed and seeded immediately following construction to stabilize exposed soil and prevent erosion.  3.  A living fence composed of

either Dogwood or Rhododendron shrubs shall be planted at the 50-foot buffer zone every 10 feet.  4.  Any changes to the approved plans shall be brought before the Conservation Commission for review.  – Signed

Order of Resource Area Delineation to confirm the accuracy of the areas of delineation as provided by a DEP Bordering Vegetated Wetland field data form at 30 Holmes Street, Assessor’s Map 75, Lot 5 for Anthony Kolacz, 108 Elm St., E. Bridgewater, MA.  (DEP #175-421):  1.  Because of the historic maintenance of the lawn at the existing house, the wetland line was approved even though the soils are hydric.  2.  Notice of Intent shall be filed for any proposed work o the remaining property for crossing and associated enhancements. – Signed

Order of Conditions for construction of a single family house and septic system on West side of Union St., Assessor’s Map 31, Lot 7A & 6, for Elko Construction, Inc., P.O. Box 485, Hanson, MA  (DEP #175-369) with special conditions:  1.    The variance to place the driveway and a portion of the proposed house within the 50-foot No-disturb zone to the wetland bog area was approved.  2.   A row of haybales and silt fence shall be installed prior to the start of construction as shown on approved plans and a site inspection shall be scheduled with the Conservation Office.  Please call 781-294-4119, Ext. 118.  3.  Any changes to the approved plan will require the review of the Conservation Commission to determine if an Amended Order of Conditions should be requested or if a new Notice of Intent must be filed.  4.  As shown of approved plans, 18-inch Rhododendron shrubs shall be planted 10-feet apart along the edge of the existing dirt road.  –  Signed

Discussions

Brook Bend Road, 1.92 Acres more or less, being for-closed for non-payment of taxes, see notice from Land Court.   Mr. Lindquist noted that this land abuts conservation land across the street.  It    could be used for parking and as access to a conservation trail.  In order to make it official it has to be approved in Land Court, then submitted to town meeting in an article to transfer it to Conservation.

The Board discussed the possibility of meeting on alternating Tuesdays to discuss Open Space
with Associate Members, Phil Clemons & Bob Dillon.
